Terms and Conditions

  1. 1. Introduction

    • 1.1. These terms and conditions, along with our Acceptable Use Policy and Privacy Policy (collectively, "Terms"), govern the use of the betting platform ("Platform") provided by Tradeball through the website www.Tradeball.com or its Brazilian partner sites under the registered trademark "Tradeball Network." These Terms constitute a binding legal agreement between you and Tradeball.
    • 1.2. By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms without modification. Your continued use of the Platform constitutes your acceptance of any changes or updates to these Terms.

  2. 2. Nature of the Platform

    • 2.1. The Platform is an automated service that allows you, as an authorized user ("you"), to conduct betting transactions ("Bets") with Tradeball. You expressly acknowledge that you are solely responsible for all aspects of your Bets, including their accuracy, status, and selection. Tradeball assumes no responsibility for verifying, managing, or advising on any aspect of your Bets.
    • 2.2. Due to the rapid nature of odds fluctuations and the speed of our execution processes, prices displayed may occasionally be incorrect. In such cases, any affected Bets may be voided, either during or after the event.
    • 2.3. Tradeball reserves the absolute right to change or adjust the status of any Bet, including, but not limited to, those affected by technical errors, inaccuracies, or event cancellations. Tradeball has the unconditional right to void any Bet, before or after settlement, without providing a reason. Tradeball’s decisions regarding Bets are final and binding.

  3. 3. Account Information

    • 3.1. You warrant that:
      1. a) Your use of the Platform complies with all applicable laws and third-party agreements.
      2. b) If you are an individual, you confirm you are at least 18 years of age and legally capable of entering into binding contracts.
      3. c) You will provide accurate and truthful information when requested by Tradeball for verification purposes.
    • 3.2. Tradeball reserves the right to refuse or revoke access to the Platform at its sole discretion, without an obligation to provide justification.
    • 3.3. You are responsible for the confidentiality of your account details, and Tradeball will not be liable for any unauthorized use of your account due to your failure to safeguard your credentials.
    • 3.4. Tradeball may, at any time, request additional documentation or verification to comply with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations. Until such verification is completed to Tradeball's satisfaction, withdrawal of funds exceeding €3,000 will not be permitted.
    • 3.5. Tradeball reserves the right to suspend or terminate your account if verification is incomplete, fraudulent, or if misuse is suspected, without liability.
    • 3.6. Tradeball may freeze or block transactions if required by law, regulations, or authorities, and will not be liable for any losses arising from such actions.

  4. 4. Use of the Platform

    • 4.1. You agree to use the Platform solely for lawful betting activities and in accordance with these Terms. You will not use the Platform if doing so violates any local laws or regulations applicable to you.
    • 4.2. You are fully responsible for the selection, accuracy, and value of any Bet placed on the Platform. Tradeball is not responsible for any losses, errors, or discrepancies related to your Bets, regardless of cause.
    • 4.3. You acknowledge that you are solely responsible for understanding how to use the Platform. Tradeball will not be liable for any losses arising from your failure to correctly understand or use the Platform.
    • 4.4. You agree to:
      1. a) Cooperate with Tradeball in resolving any technical issues or security concerns.
      2. b) Ensure all data provided to Tradeball is accurate and up-to-date.
      3. c) Promptly comply with your obligations under these Terms and notify Tradeball immediately of any breach.
    • 4.5. Tradeball reserves the right to hold you liable for any losses or damages arising from your failure to comply with these obligations.
    • 4.6. You may not use the Platform if you reside in a jurisdiction where its use is prohibited. Tradeball has no obligation to ascertain the legality of the Platform in your jurisdiction.

  5. 5. Reliability of Platform Data

    • 5.1. Information provided on the Platform, including indicative prices and volumes offered by Tradeball ("Offers"), are provided "as is," without any guarantee of accuracy. This includes statistics and live data, which are provided by a third-party provider—Tradeball assumes no responsibility for the accuracy of displayed statistics.
    • 5.2. You acknowledge that Tradeball will not be responsible for any inaccuracies in the Offers unless such inaccuracies are directly caused by Tradeball’s gross negligence. Furthermore, all Offers are merely invitations, meaning we cannot guarantee the availability or validity of the Offer at the time you place a Bet.

  6. 6. Platform Suspension and Maintenance

    • 6.1. Tradeball may suspend, limit, or terminate access to the Platform at any time, without prior notice and without liability, for reasons including, but not limited to, security concerns, breaches of these Terms, or to comply with legal or regulatory demands.
    • 6.2. Access to the Platform may be temporarily interrupted for maintenance or improvements. Where possible, Tradeball will provide advance notice of such interruptions, but is not obliged to do so.

  7. 7. Exclusions of Liability

    • 7.1. Tradeball does not warrant the continuous availability, security, or error-free operation of the Platform. The Platform is provided on an "as is" and "as available" basis.
    • 7.2. Tradeball will not be liable for any defects, interruptions, or errors in the Platform unless caused by Tradeball’s gross negligence.

  8. 8. Ownership

    • 8.1. The Platform, including its underlying software and content, is the exclusive property of Tradeball. You do not receive any proprietary rights or interests in the Platform and may use it only in accordance with these Terms.

  9. 9. Indemnification

    • 9.1. You agree to indemnify, defend, and hold harmless Tradeball from any claims, losses, liabilities, or expenses arising out of your use of the Platform or any breach of these Terms.

  10. 10. Limitation of Liability

    • 10.1. To the maximum extent permitted by law, Tradeball disclaims all implied warranties and conditions.
    • 10.2. Tradeball’s total liability to you for any claims arising out of your use of the Platform shall not exceed £50,000 or the total amount you paid to Tradeball in the six months prior to the claim, whichever is less.

  11. 11. Termination

    • 11.1. Tradeball reserves the right to terminate your access to the Platform at any time, without notice, if you breach any of these Terms or provide incorrect information.

  12. 12. Privacy

    • 12.1. Tradeball will process your personal information in accordance with our Privacy Policy. You consent to this processing by agreeing to these Terms.

  13. 13. Confidentiality

    • 13.1. You agree to keep all information provided by Tradeball confidential and use it solely for purposes related to the Platform. Unauthorized disclosure may result in legal action.

  14. 14. Force Majeure

    • 14.1. Tradeball will not be liable for any delays, failures, or damages arising from events beyond its reasonable control, including acts of nature, government actions, or technical failures.

  15. 15. Amendments

    • 15.1. Tradeball reserves the right to amend these Terms at any time by posting the updated Terms on the website. Such amendments will take effect 30 days after posting, and your continued use of the Platform constitutes acceptance of the amendments.

  16. 16. Assignment

    • 16.1. Tradeball may assign or transfer its rights and obligations under these Terms without your consent. You may not assign your rights or obligations without Tradeball’s written approval.

  17. 17. Entire Agreement

    • 17.1. These Terms represent the entire agreement between you and Tradeball regarding the use of the Platform and supersede any prior agreements or understandings.

  18. 18. Severability

    • 18.1. If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions will continue in full force and effect.

  19. 19. Governing Law and Jurisdiction

    • 19.1. These Terms are governed by and construed in accordance with English law. Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
